This website accessible through the http://www.jmweston-invite.com address, is published by J.M Weston, a simplified joint stock company (SAS) with capital of 2,288,000 euros and whose registered office is located at Z.I. Nord, rue Nicolas Appert, 87021 LIMOGES, recorded in the LIMOGES trades and companies register under number 332 037 662.

The hosting of the website is provided by Gandi, 15 place de la Nation à Paris (75011) FRANCE. Access to the Site and the use of its content are made in accordance with the terms of use described below. Accessing and navigating on the Site constitutes the user's unconditional acceptance of the following terms & conditions of use:

II. COPYRIGHT - INTELLECTUAL PROPERTY

2.1 Ownership

J.M WESTON is the owner of the domain names http://www.jmweston-invite.com. The Site as a whole, as well as its components (including text, the tree structure, software, animations, photographs, illustrations, diagrams, graphics, logos, etc.) constitute intellectual works protected by articles L.111-1 et seq. of the Intellectual Property Code. JM WESTON has the exclusive right to use the intellectual property rights and personality rights relating to the Site and its component parts, including trademarks, templates, copyright and image rights, whether original or due to the effect of a licence or express permission.

2.2 Sanctions

The use of all or part of the Site, including downloading, reproduction, transmission, representation or dissemination for purposes other than for personal, private use for non-commercial purposes by the user is strictly prohibited. Infringement of these provisions subjects the perpetrator to the penalties provided by the Intellectual Property Code for the infringement of copyright (Article L.335-3), trademark law (Article L.716-9 ) and the Civil Code regarding liability (Article 9, Articles 1382 et seq.).

2.3 Hyperlinks

The creation of all hyperlinks to any web pages or components of the Site is prohibited without the prior written consent of JM WESTON. This authorisation may be revoked at any time. All sites with a hyperlink to the Site or any of its components are not under the control of JM WESTON which therefore disclaims all liability (in particular, editorial) regarding the access to and content of these sites.

III CONTRIBUTIONS BY USERS

3.1 Users may submit contributions to the JM WESTON Site by sending messages to the address, jmwestoninvite@jmweston.fr (hereinafter called the "Contributions") on the understanding that JM WESTON reserves the right to publish or not to publish these Contributions with no obligation on its part.

3.2 The contributing user when submitting his Contribution to JM WESTON grants to JM WESTON the non-exclusive and transferable right (including sub-licence rights), at no cost and for the whole world, to use, reproduce, distribute, prepare derivative works, represent and execute the Contribution to the Site or in connection with JM WESTON's business, in particular, without this being exhaustive, for promoting its products in any format, on any medium and through any distribution channel for the duration of copyright.

3.3 In any event, the contributing user remains liable for the data he sends, uses or transfers to JM WESTON and in this matter, undertakes to respect the French legislation in force, particularly that relating to manifestly illicit content (of an immoral nature, inciting racial hatred, child pornography, defamation, etc.) or the protection of third party rights (intellectual property rights, etc.) and indemnifies JM WESTON against any recourse in this regard. Accordingly, the contributing user agrees to (i) indemnify J.M. WESTON for all expenses incurred by any application and/or legal or pre-legal proceeding brought by third parties due to the breach by the contributing user of his guarantee obligation including its costs and lawyers' fees, and (ii) to pay to third parties any sums resulting from convictions borne by J.M. WESTON including convictions under Article 700 of the New Code of Civil Procedure.

IV. PERSONAL DATA

4.1 Data that is personal

Personal data means personal information (in particular: username, password, name, date of birth, e-mail and postal addresses, city, state/province) that users may provide to J.M. WESTON as part of requests for information or contributions through the e-mail address jmwestoninvite@jmweston.fr. These data, whatever their type, enable J.M. WESTON, either directly or indirectly to identify and better understand the users and send them information by electronic channels.

4.2 Consent

No personal data is collected without the consent of the users. The optional or compulsory nature of the information to be communicated to J.M WESTON regarding this shall be indicated beforehand to the users. The latter have no obligation to forward personal data to J.M WESTON.

4.3 Identity of the entity responsible for processing personal data

The company, J.M WESTON is responsible for collecting and processing personal data given on the Site.

4.4 Recipient(s) of personal data

The company, J.M WESTON is the sole recipient of personal data collected on the Site. Personal data shall not be disclosed to third parties.

4.5 The users' rights

4.6 Cookies

J.M WESTON may install a "cookie" (alphanumeric identifier) on the hard disk of the user's computer with the sole purpose of being able to recognise him during consequent visits to the Site. The storing of information about the user's navigation on the Site supplied by a cookie shall not exceed one year. It is recalled that a user may prevent cookies being written on his hard disk by configuring his browser software (Internet Explorer, Netscape ...) to do so. To this end, he is advised to refer to the instructions (in the "Help" section of the browser's toolbar) of its software for browsing the Internet or finding relevant information from the publisher of the said software.

V. LIABILITY

J.M WESTON strives to ensure, to the best of its abilities, the accuracy and updating of the information contained on the Site, whose content it reserves the right to correct, at any time and without notice. However, JM WESTON cannot guarantee the accuracy, precision and completeness of the information provided on the Site and this information shall not constitute a guarantee or commitment by J.M WESTON to the user. In particular, JM WESTON cannot be held liable for:

• any lack of precision, inaccuracy or omission in the information available on the Site ;

• for any damage resulting from computer intrusion by a third party leading to changes in information made available on the Site ;

• and more generally, any damage, either direct or indirect, whatever the causes, origins, nature and consequences caused as a result of anyone accessing the Site or the inability to access it, as well as the use of the Site and/or reliance on any information provided, either directly or indirectly, from it.

J.M WESTON has implemented resources whose purpose is to ensure the security of the files made up of data of a personal nature collected on the Site. It is however recalled that JM WESTON does not control the risks related to the operation of the Internet and draws the attention of users to the existence of potential risks concerning the confidentiality of information transmitted via this network.

VI. CHANGES TO THE TERMS OF USE

J.M WESTON informs users visiting the Site that these terms may be changed at any time. These changes are published by their presence on-line and are deemed to have been accepted without reservations by any user who accesses the Site after they are posted on-line.

VII. DISPUTES

These terms are established in accordance with French law and in particular the provisions of Law No. 2004-575 of 21 June 2004 "Confidence in the Digital Economy" and Law No. 78-17 of 6 January 1978 "Data Processing and Liberties" as amended by Law No. 2004-801 of 6 August 2004 "on the protection of individuals with regard to the processing of personal data". French courts have territorial jurisdiction over any dispute arising from the use of the Site, unless otherwise stipulated by the Brussels Regulation of 20 December 2000 on the jurisdiction and enforcement of judgements.
